01 Who provides the service

Intellectum AI Solutions S.A.S. is an Ecuadorian company that designs and implements artificial intelligence agents and assistants (WhatsApp, social media, web chat and voice), automated sales funnels, websites, online stores and custom workflows for businesses.

02 What these terms cover

These terms apply to:

• The site www.intellectum.ec.
• The virtual assistant IntelliA, both in the site's chat and on the WhatsApp numbers published there.
• The free 30-minute consultation and its booking.

By writing to us on any of these channels you accept these terms. Projects hired afterwards are also governed by the proposal and the contract signed with each client; if that contract says something different from this page, the contract prevails.

03 The virtual assistant IntelliA

IntelliA is an automated assistant, not a person. It says so from its first message and answers using artificial intelligence, drawing on information about our services. You can ask to speak to someone from the team at any time.

• The figures it gives are indicative. The assistant can state each plan's reference rates and an estimate based on what you tell it; only a written quote, with its scope and validity, binds Intellectum.
• It does not close contracts or make binding decisions. Every commercial proposal is reviewed by a person before it is sent.
• It can be wrong. Its answers are for guidance. What binds the company is what is set out in writing in a signed proposal.

04 Conversations on WhatsApp

We answer on WhatsApp through Meta's official WhatsApp Business API. You always start the conversation: we do not send promotional messages to numbers that have not written to us.

• We reply about what you asked, to arrange a call or to follow up on a project under way.
• Any data or messaging charges your mobile operator applies are yours to pay.
• You can stop receiving messages at any time by writing SALIR (or BAJA, or STOP) in the conversation: the opt-out applies instantly and automatically, and your conversation history is deleted. You can also ask in your own words or write to info@intellectum.ec — someone from the team handles it within 24 hours.
• You can also block or report the number from the WhatsApp app itself.

05 Acceptable use

When using our channels you agree not to:

• Use them for unlawful, fraudulent or deceptive activities.
• Impersonate another person or company.
• Send offensive or discriminatory content, unsolicited advertising or malicious software.
• Attempt to breach, overload or mass-extract information from the site, the assistant or our systems.
• Type sensitive data into the chat: national ID numbers, bank details, card numbers or passwords. We don't ask for them and we don't need them.

We may suspend service on these channels for anyone who breaks these rules.

06 Quotes, prices and payment

Rates. Each plan has a reference rate that the assistant can state to anyone who asks. Every solution is quoted to fit, based on scope, the integrations needed and the volume of use. Every quote is delivered in writing, states what it includes and carries a validity period set out in the document itself.

• Figures published and quoted from 11 September 2026 already include the VAT in force in Ecuador: nothing is added when we invoice. Quotes and proposals issued before that date are honoured exactly as they were given.
• General payment terms: 60% at the start of the project and 40% on completion of the implementation, unless the proposal says otherwise.
• Payment methods: bank transfer or deposit. Card payment through a gateway becomes available in October 2026; until then it is not offered.
• Every service is invoiced in accordance with Ecuadorian tax rules.

If the agreed payment is not made or is delayed, the service may be discontinued with 48 hours' notice.

Delivery times are set in each proposal and depend on the client providing the information, access and approvals needed on time.

07 The free consultation

We offer a free, no-obligation 30-minute consultation, Monday to Friday from 09:00 to 17:00 (Ecuador time). Saturdays are by prior appointment arranged with someone from the team; on Sundays and public holidays there is no human attention.

You can reschedule or cancel it by writing to us on the same channel. If nobody joins, we treat it as cancelled and can book it again.

08 Confidentiality and intellectual property

The business information you share with us during the assessment and the implementation is confidential. Every integration with a client's systems is agreed under a non-disclosure agreement (NDA).

The Intellectum brand, the site, its texts, its design and the assistant's own software belong to Intellectum AI Solutions S.A.S. The deliverables built for a client and the ownership of their data are set out in each project's contract.

09 Availability and liability

The site and the assistant are offered as they are. We aim for them to run without interruption, but they may become unavailable because of maintenance or failures at the technology providers they depend on (hosting, artificial intelligence models, WhatsApp).

We do not guarantee specific commercial results — sales, savings or number of clients — from using the site or the assistant. A project's measurable commitments, where there are any, are set out in its proposal.

To the extent the law allows, Intellectum's liability to a client for a hired project is limited to the amount actually paid for that project. Nothing in these terms limits the rights Ecuadorian law grants to consumers.

10 Personal data

How we handle the personal data we collect on the site, in the chat and on WhatsApp is explained in the privacy notice, which forms part of these terms. There you will find what we keep, for how long, which providers it is shared with, and how to ask for access, correction or deletion.

11 Changes to these terms

We may update these terms. The version in force is always the one published on this page, with its update date. If a change is substantial and affects a project under way, we tell the client by email.

12 Governing law

These terms are governed by the laws of the Republic of Ecuador. Any dispute will be addressed in good faith between the parties and, failing that, submitted to the competent courts of the city of Quito.
