Intellectum AI Solutions S.A.S. is the controller of the personal data collected through the site www.intellectum.ec, through its virtual assistant IntelliA and through its contact channels.
02 What data we collect
Only what you give us voluntarily in the conversation or in the forms: name, email address, phone or WhatsApp number, company, role and a description of the process you want to solve. We also record the content of your conversation with the assistant and basic technical data about the visit.
If you send us a voice note, it is transcribed automatically so that it can be read: we keep the text, not the audio. The same goes for photos, documents and videos: they are read at the time so we can reply to you, and all that remains in the conversation is a note saying you sent them.
If you speak to our voice agent on the phone, we keep your number, a summary of what you discussed and the recording of the call, which is held by the telephony provider listed below. The agent tells you when it greets you that it is an artificial intelligence and that the call is recorded. Every call is recorded, with no exceptions: there is no way to turn the recording off for a single call. If you prefer it not to be recorded, the call ends there and you can reach us through the other channels in this notice.
If you accept a proposal online, we keep, from that acceptance, the details of the party contracting (registered name, tax ID, city and address), those of the person accepting (name, role and email), the date and time, the version of the contract with its verification code, the time you confirmed your email with the six-digit code we sent you (we keep nothing of the code itself) and, so that the acceptance can be proven, your IP address and the details of the browser you accepted from. That record cannot be altered afterwards: it is the evidence Ecuador's E-Commerce Act requires, and the same day it reaches you by email together with the full contract.
To stop anyone trying to guess that code or sending request after request, we count how many attempts arrive each hour from the same connection and for the same proposal. That count does not keep your IP address, only a fingerprint of it signed with a secret server key, and it is deleted the next day.
We do not ask for or store national ID numbers, bank details, card numbers or passwords. Please don't type them into the chat.
03 What we use it for
- Answering your question and handling your request to be contacted.
- Preparing a proposal and arranging the free 30-minute consultation.
- Improving the quality of the assistant's answers.
We do not use your data for third-party advertising, we do not sell it, and we do not pass it on for commercial purposes.
04 On what legal basis
We process your data on the basis of your consent, which you give by writing to us voluntarily, and on the basis of pre-contractual steps taken at your request. You can withdraw your consent at any time, without affecting the lawfulness of the processing that took place before.
The record of an online acceptance is the exception, and its basis is a different one: performance of the contract and compliance with legal obligations. While the contract exists we cannot delete or alter it, because it is the proof of what was agreed — for you as much as for us — even if you withdraw your consent for everything else.
05 Who else can see it
To run the site and the assistant we use technology providers located outside Ecuador, mainly in the United States. Unless stated otherwise, they all handle the data on our behalf, as processors:
- Anthropic — artificial intelligence model.
- Supabase — database.
- Vercel — site hosting.
- Resend — email delivery.
- Meta Platforms — WhatsApp Business, on our behalf. And, only if you allow it, site measurement: there Meta does not act on our behalf but as an independent controller of that data, under its own terms and for its own purposes.
- Cloudflare — transcription of the voice notes you send over WhatsApp.
- Dapta — voice agent calls, their transcription and their recording, which it stores in the United States.
- Google — calendar, only if you book an appointment with us.
These international transfers take place under the data processing agreements that form part of each provider's terms of service, which require security measures from them and forbid them from using the information for their own purposes. With the voice call provider we are signing that agreement separately.
Site measurement is the exception, and we would rather tell you than leave it out: when you accept it, Meta also uses that data for its own advertising purposes, under its own terms, and we do not control that use. That is why it never turns on by itself: it only works if you say yes, and you can say no.
06 If an authority asks for your data
A public authority — a prosecutor, a judge, the police — may ask us for information about a person. When that happens:
- We check that the request is lawful: that it comes from a competent authority, in writing, identifying the case and the rule it relies on, and with a court order where the law requires one. Anything that arrives by phone or by message is not acted on.
- If the request is unlawful or excessive, we refuse in writing and, where necessary, answer through a lawyer.
- If it is legitimate, we hand over only what was asked for: that person's data, for the period requested. We never hand over the whole database or other people's conversations.
- We keep a record of every request and of our answer.
- We tell you that we handed over your data, unless the law or the order itself forbids us from doing so.
In the twelve months before the date this notice was updated, we have not handed personal data to public authorities in response to national security requests.
07 Site measurement
This site may use the Meta pixel to understand which content people find useful and to show ads to people with similar interests. It is not needed to browse the site or to write to us.
It only turns on if you accept it. The first time you arrive we ask you, and until you answer no measurement tool is loaded and nothing is sent to Meta. If you say no, that is respected and we don't ask again.
Your answer is stored in your own browser's local storage, not on our servers. If you clear the site's data or arrive from another browser or device, we will ask you again. You can change your mind whenever you want by clearing this site's data in your browser.
When measurement is on, Meta receives the address of the page you visit, technical data about your browser and specific moments — for example, that you opened the chat or booked an appointment. We do not send it your name, your email, your phone number or the content of your conversations with the assistant.
08 How long we keep it
Contact data is kept for as long as the business relationship lasts and for up to two years after it ends, unless a legal obligation requires us to keep it longer. The history of conversations with the assistant is deleted automatically after 90 days.
The record of an online acceptance — with its date, its verification code, the IP address and the browser — does not follow that rule: it is kept while the contract is in force and afterwards for as long as legal and tax obligations require. It is not deleted with the conversation after 90 days, and you can ask for a copy whenever you want.
The recording of a call does not follow that rule either, and we would rather say it plainly: it is not deleted on its own. It stays on the voice provider's servers, in the United States, until we ask for it to be deleted. If you want yours deleted, write to datos@intellectum.ec: we request it, the provider gives us written confirmation of the deletion and we forward it to you.
09 Your rights
As the data subject you have the right to access your data, correct it, delete it, object to its processing, ask for it to be restricted, ask for it to be ported, and not to be subject to automated decisions that significantly affect you.
To exercise any of these rights, write to datos@intellectum.ec stating your name and the right you wish to exercise. We will answer within a maximum of fifteen (15) business days from the day we receive your request.
If you believe your request was not handled properly, you can file a complaint with Ecuador's Superintendency for the Protection of Personal Data.
10 Automated decisions
Our virtual assistant IntelliA answers automatically and organises your enquiry for the team, and our voice agent does the same over the phone. Neither of them makes decisions that produce legal effects on you: every commercial proposal is reviewed by a person before it is sent. Both tell you from the outset that they are not people.

If we update this notice we will publish the new version on this same page, stating the date it was updated.
